HOMETRUTH™ DISCLAIMER, SCOPE OF SERVICE & IMPORTANT LEGAL INFORMATION

This Disclaimer applies to the HomeTruth website, Buyer Risk Reports, research, communications, interpretation calls and related services provided by HomeTruth (“HomeTruth”, “we”, “us” or “our”).

By requesting, purchasing, receiving or using a HomeTruth service or report, the customer (“Client”, “Buyer” or “you”) acknowledges and agrees to the following.

1. WHAT HOMETRUTH IS

HomeTruth provides independent, buyer-side property research, risk intelligence and decision-support services.

A Client retains HomeTruth to independently research and analyse information relevant to a residential property decision and to identify:

  • information supported by the sources reviewed;

  • material risk indicators;

  • inconsistencies or matters requiring attention;

  • information that could not be independently verified;

  • questions the Client may wish to raise;

  • documents the Client may wish to obtain; and

  • matters that may warrant further review by an appropriately qualified professional.

The purpose of the service is to assist the Client in making a better-informed property decision.

HomeTruth works independently for the Client purchasing the report.

2. PRIVATE CLIENT-SPECIFIC ADVISORY ENGAGEMENT

A HomeTruth Buyer Risk Report is prepared pursuant to a private research and advisory engagement initiated by the Client.

The report is prepared solely to assist that Client in evaluating a contemplated property transaction and protecting the Client's own financial and decision-making interests.

The report is not prepared at the request of, on behalf of, or for the benefit of any developer, promoter, seller, broker, lender or other third party.

Unless HomeTruth expressly agrees otherwise in writing, the report is:

  • confidential to the Client;

  • intended for the Client's own decision-making;

  • not prepared for general publication;

  • not a public rating or certification of the developer or project; and

  • not intended for reliance by any third party.

 

3. HOMETRUTH IS NOT A BROKER OR TRANSACTION INTERMEDIARY

Under its standard Buyer Risk Report service, HomeTruth does not:

  • sell real estate;

  • market inventory for developers or sellers;

  • receive developer brokerage or sales commissions;

  • introduce buyers and sellers for the purpose of negotiating a transaction;

  • negotiate the sale or purchase price;

  • negotiate contractual terms on behalf of either party;

  • collect booking amounts or transaction consideration;

  • act as an authorised representative of a developer or seller;

  • procure or facilitate a sale in return for transaction-linked remuneration; or

  • receive compensation depending upon whether the Client completes the purchase.

The Client pays HomeTruth a fixed fee for independent research, analysis and advisory services.

HomeTruth's compensation is not contingent upon the property being purchased or rejected.

Nothing in this clause should be interpreted as a representation regarding the legal classification of any activity under applicable law. HomeTruth conducts its activities subject to applicable Indian law and may modify the scope of its services where required.

 

4. SOURCES AND RESEARCH BASIS

HomeTruth reports may draw upon information reasonably identified from sources such as:

  • State RERA records;

  • government and statutory databases;

  • court, tribunal and regulatory records;

  • corporate filings;

  • credit-rating information;

  • developer/promoter disclosures;

  • sanctioned or regulatory documents where accessible;

  • institutional or established secondary sources;

  • market information;

  • publicly accessible publications and databases; and

  • documents or information supplied by the Client.

HomeTruth seeks to give greater weight to authoritative and primary sources wherever reasonably available.

The sources materially relied upon may be identified or referenced within the report where practicable.

 

5. FACTS, SOURCE MATERIAL AND ANALYTICAL OPINION

HomeTruth seeks to distinguish between:

FACTUAL INFORMATION

Information reflected in or derived from identified records or sources.

CALCULATED OR DERIVED INFORMATION

Calculations made from identified underlying information.

INFORMATION NOT INDEPENDENTLY VERIFIED

A matter for which sufficient reliable evidence was not identified during the review.

RISK INDICATOR

A fact, event, inconsistency or circumstance which HomeTruth considers relevant to the Client's property decision.

ANALYTICAL OPINION

HomeTruth's interpretation or assessment based upon the information reviewed.

Statements described as risk assessments, cautions, concerns, interpretations or overall risk views are analytical opinions, not declarations of legal liability, wrongdoing, guilt or fact beyond the supporting evidence identified.

6. MISSING INFORMATION DOES NOT MEAN NON-EXISTENCE

Where HomeTruth states that a document, approval, fact or record was “not independently verified”, “not identified in the sources reviewed”, “not available from the sources reviewed” or words to similar effect, this means only that HomeTruth did not identify sufficient reliable evidence of that item during its review.

It does not, by itself, mean that:

  • the document does not exist;

  • an approval was never granted;

  • the developer has violated the law;

  • the project is illegal; or

  • the developer or promoter has committed wrongdoing.

The purpose of identifying such an information gap is to alert the Client to a matter that may deserve direct verification.

7. REFERENCES TO LITIGATION, COURT CASES AND REGULATORY PROCEEDINGS

A reference to a complaint, court case, tribunal proceeding, regulatory matter, insolvency proceeding, investigation or dispute does not imply that the allegation has been proved or that any party is guilty of wrongdoing.

Where a matter remains pending, HomeTruth seeks to describe it as pending, alleged, disputed or otherwise unresolved, as appropriate to the source material.

Court and tribunal outcomes may subsequently be appealed, stayed, modified, settled, reversed or otherwise changed.

Clients should review the underlying order or record and obtain legal advice where a proceeding may materially affect their decision.

8. NO ALLEGATION OF WRONGDOING UNLESS SUPPORTED

HomeTruth does not intend its reports to make unsupported accusations against any developer, promoter, director, company or other person.

Terms such as:

  • fraud;

  • scam;

  • cheating;

  • illegal;

  • criminal;

  • dishonest; or

  • similar allegations of misconduct

should not be inferred from a HomeTruth risk assessment unless expressly stated and supported by an appropriate authoritative source or final legal determination.

A designation such as CAUTION, MATERIAL RISK, VERIFY, HIGH RISK or similar HomeTruth terminology describes our assessment of risk to the prospective buyer. It is not, by itself, an accusation of unlawful conduct by any person.

9. PURPOSE OF CAUTIONS AND RISK ASSESSMENTS

Any caution, risk indicator or adverse observation contained in a HomeTruth report is communicated in good faith for the purpose of assisting the Client to protect the Client's interests in a contemplated high-value property transaction.

HomeTruth's objective is not to damage the reputation of any developer, promoter or other person.

Our objective is to identify information which, in our analytical judgment, may reasonably deserve consideration by the Client before the Client commits money.

HomeTruth may identify both:

  • positive information; and

  • matters of concern.

A favourable market reputation, strong sales velocity, increasing price or popular demand does not prevent HomeTruth from identifying a material issue that it believes deserves the Client's attention.

10. INDEPENDENCE

HomeTruth seeks to maintain independence from the transaction being assessed.

Unless expressly disclosed:

  • HomeTruth does not receive compensation from the developer whose project is being reviewed;

  • HomeTruth does not receive a sales commission from the seller;

  • HomeTruth has no financial interest in whether the Client proceeds with or rejects the property; and

  • the fee for the standard Buyer Risk Report is payable for the research and analysis itself.

HomeTruth may disclose any known material conflict of interest relating to an assignment where appropriate.

11. NO CERTIFICATION, CLEARANCE OR GUARANTEE

HomeTruth is not:

  • a government authority;

  • a statutory regulator;

  • a title-certifying authority;

  • a court or tribunal;

  • a credit-rating agency;

  • a structural engineer;

  • an architect;

  • a chartered accountant acting as statutory auditor;

  • or the Client's lawyer.

HomeTruth does not issue:

  • title certificates;

  • legal clearances;

  • statutory approvals;

  • construction-quality certificates;

  • solvency guarantees;

  • investment guarantees; or

  • guarantees concerning possession, appreciation, resale, rental yield or future performance.

A HomeTruth risk view is an analytical decision-support tool, not a statutory certification.

12. NOT LEGAL TITLE DUE DILIGENCE

A HomeTruth Buyer Risk Report does not constitute a formal legal title search, conveyancing due diligence or legal opinion.

Where relevant, the Client should instruct an independent qualified property lawyer to examine matters including:

  • ownership and title chain;

  • encumbrances;

  • mortgages and charges;

  • land rights;

  • agreements;

  • title documents;

  • contractual rights and obligations;

  • enforceability;

  • statutory permissions; and

  • transaction-specific legal risks.

HomeTruth may identify issues that warrant such legal review but does not replace it.

13. NO TECHNICAL OR PHYSICAL INSPECTION

Unless separately agreed in writing, HomeTruth does not physically inspect:

  • construction quality;

  • structural integrity;

  • workmanship;

  • fire systems;

  • utilities;

  • water systems;

  • sewage systems;

  • environmental conditions;

  • measurements;

  • site boundaries;

  • physical possession conditions; or

  • compliance of construction on the ground with sanctioned plans.

Such matters should be independently examined by appropriately qualified professionals where material to the Client's decision.

14. NO FINANCIAL, TAX OR INVESTMENT ADVICE

HomeTruth may analyse publicly available financial, pricing, credit, market or developer information.

Such analysis does not constitute:

  • investment advice;

  • financial planning;

  • securities advice;

  • tax advice;

  • valuation certification; or

  • a promise of financial return.

Every property transaction carries financial and market risk.

The Client remains responsible for determining whether the proposed transaction is appropriate for the Client's personal circumstances.

15. PUBLIC INFORMATION MAY CHANGE

A HomeTruth report is prepared as of the date stated in the report.

Public records and circumstances may change after that date.

For example:

  • a new approval may be granted;

  • an approval may expire or be modified;

  • a case may be filed, withdrawn, settled or decided;

  • a court order may be appealed or stayed;

  • a RERA record may be updated;

  • financial circumstances may change;

  • project timelines may be revised;

  • construction may progress; or

  • new information may become available.

HomeTruth has no obligation to continuously update a delivered report unless a monitoring or update service has been expressly purchased.

16. REASONABLE RESEARCH, NOT A WARRANTY OF PERFECT INFORMATION

HomeTruth applies a structured research and analytical process intended to exercise reasonable care in identifying and interpreting relevant information.

However, no research process can guarantee that every existing fact, document, proceeding, filing or development will be discovered.

Government databases, court systems, corporate records and other sources may contain:

  • errors;

  • delays;

  • omissions;

  • inaccessible documents;

  • incorrect indexing;

  • outdated information; or

  • technical limitations.

Accordingly, HomeTruth does not warrant that a report is exhaustive or that every possible property risk has been identified.

This does not affect HomeTruth's commitment not to knowingly fabricate information and to correct material factual errors brought to its attention where appropriate.

17. CORRECTIONS AND RIGHT TO PROVIDE INFORMATION

HomeTruth welcomes good-faith corrections supported by credible documentation.

If a Client, developer, promoter or other affected party believes that a HomeTruth report contains a material factual error, supporting information may be sent to:

support@hometruth.in

Please identify:

  • the specific statement disputed;

  • why it is believed to be incorrect;

  • the relevant supporting document or authoritative source; and

  • current contact details.

HomeTruth may review credible new evidence and, where appropriate, correct, clarify or update its records or report.

Submission of a correction request does not itself establish that the challenged information was incorrect.

 

18. CONFIDENTIALITY AND RESTRICTION ON PUBLICATION

The Buyer Risk Report is licensed to the Client solely for the Client's personal property-decision purposes.

Without prior written permission from HomeTruth, the Client must not:

  • publish the full report online;

  • upload the report to social media or public forums;

  • reproduce substantial portions publicly;

  • sell or commercially redistribute it;

  • alter the report and attribute the altered version to HomeTruth;

  • use excerpts in a misleading or out-of-context manner; or

  • represent that HomeTruth has publicly accused or certified any person or project.

The Client may share the report confidentially with the Client's lawyer, accountant, financial adviser or other professional adviser for the purpose of evaluating the contemplated transaction.

If the Client independently republishes or misrepresents the report outside the authorised scope, that publication is the Client's own act and may be subject to the Client's indemnity obligations under the Terms.

 

19. NO THIRD-PARTY RELIANCE

A report is prepared for the named Client based upon the identified project and the circumstances understood at the time.

No developer, promoter, broker, investor, lender, subsequent purchaser or other third party is entitled to rely upon the report without HomeTruth's written agreement.

HomeTruth assumes no duty of care to any unauthorised third-party recipient to the maximum extent permitted by applicable law.

20. CLIENT'S FINAL RESPONSIBILITY

A HomeTruth report is one input into a significant financial decision.

The Client is responsible for:

  • reviewing the report;

  • asking relevant follow-up questions;

  • obtaining documents identified for verification;

  • engaging qualified professionals where necessary;

  • independently verifying matters material to the transaction; and

  • making the final decision whether to proceed.

HomeTruth does not make the transaction decision on behalf of the Client.

21. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, HomeTruth and its founders, officers, employees, analysts, contractors and affiliates will not be liable for indirect, incidental, consequential, special, exemplary or punitive loss arising from use of the service, including loss of:

  • profit;

  • opportunity;

  • expected appreciation;

  • rental income;

  • financing;

  • business;

  • savings; or

  • resale value.

Subject to applicable law, HomeTruth's aggregate contractual liability arising from a particular paid Buyer Risk Report will not exceed the amount actually paid to HomeTruth for that report.

Nothing in this clause excludes liability that cannot lawfully be excluded or limited.

22. CLIENT MISUSE AND INDEMNITY

The Client is responsible for the manner in which the report is used after delivery.

To the extent permitted by applicable law, the Client agrees to indemnify HomeTruth against third-party claims, losses or reasonable costs arising directly from:

  • unauthorised public dissemination of the report by the Client;

  • alteration or manipulation of the report;

  • publication of report content out of context;

  • representation that HomeTruth made a statement that does not appear in the original report;

  • use of the report for harassment, extortion, commercial disparagement or another unlawful purpose; or

  • breach of the permitted-use restrictions.

This indemnity does not apply to liability arising solely from HomeTruth's own unlawful conduct.

 

23. INTELLECTUAL PROPERTY

The HomeTruth name, branding, methodologies, report architecture, research workflows, scoring or classification systems, templates, presentation formats and original analytical content are proprietary to HomeTruth or its licensors.

Payment for a Buyer Risk Report grants the Client a limited, personal, non-exclusive and non-transferable licence to use that report for the Client's contemplated property decision.

No ownership of HomeTruth's methodology or intellectual property is transferred to the Client.

 

24. NAMES AND TRADEMARKS OF DEVELOPERS

Developer, promoter and project names, logos and trademarks referenced by HomeTruth remain the property of their respective owners.

References are made solely for purposes of identification, research, commentary and analysis.

Such reference does not imply:

  • sponsorship;

  • affiliation;

  • partnership;

 

25. NO DEVELOPER APPROVAL OF THE REPORT

HomeTruth does not require a developer's consent to provide a Client with independent analysis of information lawfully available to HomeTruth.

Unless expressly stated, a developer or promoter has not reviewed, approved, sponsored or endorsed the report.

Where HomeTruth relies upon statements originating from the developer, those statements may be identified as developer/promoter disclosures rather than independently established facts where appropriate.

 

26. WEBSITE CONTENT VS CLIENT REPORT

General material on hometruth.in is educational and informational.

A Buyer Risk Report is a separate, project-specific engagement prepared for a Client.

General website material should not be treated as an assessment of any particular property unless HomeTruth expressly identifies it as such.

 

27. CHANGES AND UPDATED INFORMATION

If material new information comes to HomeTruth's attention after a report has been issued, HomeTruth may, but is not obligated to, update or supplement the report unless an update service forms part of the Client's purchase.

An updated report supersedes the earlier version only to the extent expressly stated.

28. GOVERNING LAW

The HomeTruth service is governed by applicable laws of India.

Any contractual jurisdiction provision contained in HomeTruth's Terms & Conditions operates only to the extent permitted by applicable law and does not override any mandatory statutory jurisdiction.

  • HOMETRUTH RESEARCHES INFORMATION, IDENTIFIES RISKS AND PROVIDES INDEPENDENT ANALYTICAL OPINION FOR THE CLIENT'S DECISION.

  • A RISK FINDING IS NOT, BY ITSELF, AN ACCUSATION OF ILLEGAL CONDUCT.

  • INFORMATION THAT COULD NOT BE VERIFIED IS IDENTIFIED AS SUCH — NOT PRESENTED AS PROOF THAT IT DOES NOT EXIST.

  • THE CLIENT SHOULD OBTAIN SPECIALIST LEGAL, TECHNICAL OR FINANCIAL ADVICE WHERE REQUIRED.

  • MATERIAL FACTUAL CORRECTIONS SUPPORTED BY CREDIBLE EVIDENCE WILL BE REVIEWED.
